Speaking of lawsuits

can people who share music with the, “PROMOTIONAL ONLY not for sale” Stamp on it get sued for sharing that? THe reason I ask is becuase in sharing it your NOT SELLING it and therefore following the rules of said CD.
For example the Piss single Says that so if somebody were to share that cd would it still be piracy?
Just wonderin’

But isn’t “sharing” just the other term for piracy to the pencil-pushers in washington?

Not sure, just wondering if someone could make that point and what the actual law would be. Guess what it boils down to is what’s the bigger “no no” sharing or selling it?

don’t do it. repeat. don’t do it.
doesn’t matter if it’s promo only.

here i am a big expert. but yeah, i AM.
(don’t ask)

Does it have a copyright notice on it? That should be your answer.

Yeah but television shows have copyrights and and it’s not illegal to share those…is it? Meaning if I have showtime and my buddy doesn’t I have to send him hom when “Dexter” comes on? Or maybe he doesn’t have cable at all Does that mean they go home as soon as the television is turned on and they never get to see “House”? Or does the problem show up if I make a copy from the television. but the only shows that have that disclaimer are sports events and I thought that it was just for the gamblers

I’m pretty sure it is illegal. They just shutdown a few of the sites that “re-play” television shows. So I would imagine if they’re cracking down on those sites, it’s likely illegal.

(never got the chance to watch dexter…)

It’s so good. It’s vigilante justice at it’s best! a serial killer who kills serial killers.

I’ve been a bit of tool lately when it comes to tv. Been watching Californication and Weeds (same channel, which is shocking that i’ve yet to see that show). And i’m fiending for another show that starts tuesday, which for “man’s sake” I can’t name (cough…it’s on FX…cough).

Californication was a bit of a sleeper for me…Watched it only because it was on after weeds (Which has been HORRIBLE this season) but now I really like it Hank Moody is just such a likeable guyand the sory is pretty good. THought it was just going to be a tittie-fest when it first started but I think that was obviously just the hook. Dexter, my girly and I, started watching on the reruns and man were we hooked! We bought the season just cause we couldn’t wait for the weekly reruns to see what had happened. EXCELLENT Show! I don’t think it’s as good as “House” but certainly VERY close.

I love Dexter. Great show.

Californication took an episode or two to really find it’s place, I think. But I enjoy it. For Weeds, this is the only season of that show that i’ve seen, but I plan on getting the other seasons on dvd soon. But I figure, if I can watch that one FX show, I can watch anything. And that’s not a bad thing at all.

Oh man are you being robbed!! if this season of weeds is the first one you’ve seen you are a forgiving fella’!! If it wasn’t for the first two seasons I completely would’ve changed the channel by now. I just know how it used to be and I’m waiting for it to get back to that. The writing and the story are so BAAAAAD now its pathetic. I haven’t been following who the writers are except for Gengie Cohen(I think is the creators name) but it doesn’t seem like she/he is still writing maybe just producing now.

it’s illegal.
is anyone gonna care if you forward something to your grandma? no. they will hunt you down if you’re sending stuff to your ten thousand best friends. look at that lady who a couple of weeks ago i think was ordered to pay the labels over 200 grand for file sharing which she claimed didn’t happen.
the feds are all over this now.
in a way, it’s good, because the artists should make something off the use of their work. kill me for that thought. but c’mon, how else can songwriters, screenwriters etc. stand a chance to buy their groceries if everyone thinks it’s ok to steal?
yes, everyone has to tour now to make money, because cd sales are stagnant. they chose their profession, i know, and times change. but as fans, let’s cut some slack. musicians don’t get those big advances anymore. they’re far better off ditching the labels and doing it on their own. all of you can cite the examples.
the business has changed.
it’s not healthy to have talented people left in the lurch because of pilfering on the internet.
alright then, kill me (and no, i won’t be leaving my heirs with 70 years of royalties) i only know the talent.

Well what is with the “promo only” deal then. Secondly I’m all for artists getting paid but they really don’t they get like a nickel a for every cd that is sold there money comes from TICKET SALES and T-SHIRTS and other LITTLE TRINKETS…So with that said it would stand to reason that Artists ARE still getting paid because now MORE people are allowed to hear their music whenever they want for free which means more $$$ for concerts and shirts and trinkets Which was stated before THAT’S WHERE THE ARTIST GETS PAID! ne way

oink got busted - and they said that oink was responsible for leaking over 60 pre-release album versions during the year - which means only promos or “advance copies”, whatever that is.

that, and some woman was sentenced for a huge fine for having alot of mp3s on her computer - it was all over the internet in the past few weeks.

they were also asked is it okay to rip for personal purposes - i.e. i have a cd and i wanna listen to it in my portable player, can i rip it without sharing - they said no, we consider it stealing, with a possibility of a lawsuit.

so there you go, it’s illegal, case closed.

THe oink site was what was fueling my question

sure artists who can still afford to do so get tour buses(@1000 dollars a week, and up). they have to pay a merchandising person at each venue(unless they bring their own–another cost) and give the club very often a cut of the merchandise sales. no wonder ticket prices are in the 35-45 dollar range. or more.
a lot of labels no longer give “tour support”, where the label eats the costs. the bands now do.
sorry to argue with you grmpysmrf, and i wish the reality of being in a band today were different… it’s not.
and i’m not sitting around crying about it, just want everyone to appreciate the reality of what’s going on.

sorry to argue with you grmpysmrf,

Don’t apologize besides were not arguing just writing. Ideas and what not…

yea maybe the artist get shit from their cd sales, but it’s not actually artists who will sue but the labels, or so it seems.

I was reading the producer is the one who gets hit the hardest with the way things are right now.
