Speaking of lawsuits

i have a cd and i wanna listen to it in my portable player, can i rip it without sharing - they said no, we consider it stealing, with a possibility of a lawsuit.

what? bullshit. DMCA allows you make digital back-up copies for your personal use (no sharing/selling).

Prove it otherwise.

they were also asked is it okay to rip for personal purposes - i.e. i have a cd and i wanna listen to it in my portable player, can i rip it without sharing - they said no, we consider it stealing, with a possibility of a lawsuit.

so there you go, it’s illegal, case closed.
Ah, so they’ve changed that, then. It used to be okay to own copies of anything that you had previously purchased - that’s how video game ROM sites got away with it for so long. So, it’s illegal now…and yet, I can still buy the software and tools necessary to do it? Meh, whatever.

As for the “promotional” thing - I’ve bought about thirty of those bad boys in used bins, so SOMEONE is ignoring it. [:)] I don’t see how something could be much of a promotional tool if only one person ever gets to hear it - the purpose should be to spread it around. Not sell it for personal gain, but show it to any that might be interested?

You’re not “supposed” to share the promo cds, because you’re not “supposed” to have them. They’re technically the property of the record label, but have been loaned out to… I don’t know, I suppose journalists and radio stations or whatever.

Most of the promos I’ve got have the gold stamp, but I have 1-2 with the big white “Legal Notice” sticker that spells it out really clearly:

there are ways of sharing promo cds, believe me. Still, if you’re a journalist and the band or label is nice enough to send you free shit, might as well respect their trust in you and keep the promo to yourself…

when someone sends you, as a journalist, a piece of music to review, you are just like the librarian down the street or the school teacher who wants to provide an example of a particular genre. it’s called fair use, which i don’t think anyone here has talked about yet. yeah, for educational purposes, for purposes of critique, you are not getting a knock on your door.
everybody else, different story.
guys, look up the copyright regulations. you don’t have to be a lawyer to figure it out.
i’ve just been around this for so many years it’s a reflex at this point.

What I really like is when they send out the full CD, ia the case n all to me…sexy stuff.

Happened with the new Heaven and Hell live album, and some other stuff in the past.

dude, i was describing the interview. of course right now you won’t be up shit creek for ripping your own cds for yourself only but something tells me RIAA or whatever will work their asses off to be able to sue you for that. effectively making you buy CD for, say, home/car listening and digital version (i.e. through itunes or other crap like that) for use in your portables, milking more and more money.

i mean, they made guitar tabulatures on the internet illegal! fuckin’ guitar tabs! what the fuck is up with that?

That one really pisses me off, because no one releases tablature books anymore! If the free tabs online were cutting into a lucrative business, I’d understand, but there is no business to hurt, there.

kinda, except the more they push in this direction, the less I support their stupid labels. IMO tho, the RIAA has lost touch with consumers on most levels. They don’t hear the outcry yet, but music is not ‘food’ or ‘air’ - we can live without. It just pushes entertainment dollars into other arenas. Why pay for a stupid album twice - I’ll just buy Halo 3 instead. I still kill hours that way. Or Porn. Whatever.

As someone who works in retail (record store) I have to decry the sad state of major labels. However, I can’t in good conscious say they are making smart choices. To turn a phrase here: they aren’t winning the ‘hearts and minds’ y’know?

There no money in hearts and minds…there money in wallets. just keep the RIAA stocked with wallets, that’ll fix everything.

true, now how long beforee lyrics get taken off the net? already some are dissapearing because the were singles or some shit, so the site cant share it, i dont pay attention to such ass-covering disclaimers…
