What’s the going penalty for drugging and anally raping a 13 yr old in the US these days anyway?

In Australia you’d do two years in a minimum security facility, where you’d pass the time watching dvds, playing Xbox and attending Sex Offender counciling classes where you’d learn to ‘control’ your urges (pffft!)

And that’s if you were UNLUCKY.

I swear, you can get behind the wheel of a car, drunk and stoned out of yr mind, crash head on into an oncoming vehicle, wipe out an entire family and STILL not do jail time!

It’s pathetic. You Americans and English think that crims get off lightly in your communities but that is NOTHING compared to what happens over here. If you plead guilty and cut a deal with the Crown Prosecutor’s Office you can literally walk free after two or three years in the lockup after virtually ANYTHING! Including rape and manslaughter.

Compared to Australia, sentences imposed for serious crimes in other Western nations would be considered ‘barbaric’ here.

At the gym I used to attend, one of the trainers who worked there had a young sister who was raped by a family friend several years ago when she was 11 or 12 years old.

Apparently (Allegedly) the guy lured her into his house with some sort of offer, then once she was inside he took her into a bathroom, convinced her to strip, took photos of her, urinated on her, forced her to perform oral and anal sex acts and finally to top it all off he threatened to kill her if she told anyone.

After they arrested and charged the guy and brought him before the courts, the judge showed mercy due to the fact that this guy had recently divorced and lost his job and was not himself ever since. The judge also noted that the child had a history of ‘provocative behaviour’ in the school yard and that, on the day in question, she had not been ‘wearing panties under her short skirt’, a fact which the accused had noticed when she had sat down in a chair and he had become arroused at the sight of her exposed vagina. Supposedly he couldn’t control himself.

With a guilty plea, this moron was given six years jail and released after two and a half years, after agreeing to comply with strict conditions of release. During his time inside he learned to cook and studied Computer Science, where he earnt his diploma.

The girl has since attempted suicide, is on drugs and was pregnant at age 16. Her family have been warned that if they threaten this guy or exposed his name to the general public they risk going to jail themselves.

Fine way to fuck up a young life and a fitting analogy of the Australian legal system.

Sex offenders get light sentences everywhere. Using excuses like the perp has had a bad run recently is absolute bollocks and can in no way reduce the culpability of a sex crime. Often I think some decisions, such as light sentences for rapists, are founded on the misogyny of the judge (who has probably had a bad time with women). There was a case here a few years ago where a judge was busted with a shit load of child pornography but got away with it cos the search of his house didn’t follow due protocol. But the fact remains he downloaded all this stuff (supposedly it was very extreme child pornography) and he got away with it over a technicality. Not too long after he was practising in the courtroom again, he didn’t even get disbarred.

The willingness of a legal system that considers the rapist’s well being before the victims sickens me.

I wouldn’t be too sympathetic with Polanski over this case, regardless of whether she told him she was older than she was. He has had sex with other underage girls before, namely Nastassja Kinski who he directed in ‘Tess’. She was 15 when they started a relationship. There are stories of him leering after other young teenage girls floating around too. He’s been living the high life for 30 years; making films, has a sexy wife, etc. and has never faced up to the law over the 1978 case. It’s about time he did.

Sad, sad but fucking true. It’s due to this legal system, our city (Melbourne) has become rated as more dangerous than what New York was at it’s peak in the early 90s. It’s a fucking joke. Just this week, a case went to court where a guy had murdered a woman… 30 years after being let out of jail for, surprise surprise, stabbing another woman to death.

I’ve also spoken to friends who have relatives in the police force here in Melbourne. I tell you, the stories I hear regarding the horrors they see on a daily basis would make your hair stand on end. For every horrific story you read about in the morning paper, there’s probably fifty equally horrible crimes that you will never hear about…because there’s either no room or it’s just too awful.

Melbourne has become a truly violent place. As you have pointed out, it’s now considered to be more dangerous than New York.

At least it actually MADE IT TO COURT! Only 10% of reported rapes will ever get anywhere near a courtroom. The cops actually advise rape victims not to go through with it as the amount of trauma they have to endure is too severe and the likelihood of a conviction is so remote. Especially when a child is the victim - children are seen as being unreliable witnesses.

I’d say that yes they are aware of their surroundings not “completely aware” but aware enough BUT being aware of your surroundings and having the foresight to understand your future surroundings based on actions to present conditions is something else altogether. 13 year olds generally don’t have enough sense to be able to control/manipulate their surroundings to the degree an adult can. Which means no consent!
